1. General Terms & Scope

These Terms of Service govern the engagement between PT Kemenangan Digital Indonesia (“Service Provider”, “we”, or “us”) and the purchasing party or software licensee (“Client” or “you”).

Our engagements span two core operations:

  • Custom Engineering Engagements (13 Services): Including custom web development, Android applications, Windows desktop software, Telegram bots, automation scripts, VPS infrastructure administration, and app store deployment.
  • Proprietary Digital Products: Including the Islamic Pedia mobile application and the WP2WA Auto Notify WordPress integration plugin.

2. Ethical Standards & Prohibited Engagements

To uphold professional integrity, legal compliance, and social responsibility, PT Kemenangan Digital Indonesia strictly undertakes software engineering projects conducted in good faith and in full accordance with the laws of the Republic of Indonesia.

We unconditionally refuse and prohibit the utilization of our services for:

  • Gambling, online slot games, lotteries, or wagering platforms in any capacity.
  • Pornography, sexually explicit material, or commercial escort services.
  • Unlicensed financial schemes (predatory online lending or unverified investment vehicles).
  • Fraudulent schemes (scamming), credential phishing, skimming, unauthorized cyber-intrusion, or malware engineering.
  • Hate speech, defamation, religious/racial discrimination, or operations causing public harm.

The Service Provider reserves the right to terminate engagement contracts unilaterally with forfeiture of deposits should the Client be verified to employ deliverables for any prohibited purposes.

3. Engagement Workflow & Payment Terms

  1. Statement of Work (SOW): Engagements are initiated through formal technical proposals outlining exact feature deliverables, delivery milestones, and costs.
  2. Initial Deposit: Development begins upon receipt of a 50% mobilization deposit of the agreed contract value.
  3. Final Sign-Off & Handover: The remaining 50% balance becomes due following functional acceptance and accessibility sign-off, prior to live handover or final source repository transfer.
  4. Official Invoicing: All payments must be remitted strictly to the corporate bank account of PT Kemenangan Digital Indonesia.

4. Intellectual Property (IP) & Source Code Ownership

A. Custom Development Projects

Upon receipt of full contract settlement, 100% of the proprietary source code, database architectures, and tailored graphical assets developed exclusively for your engagement are transferred unconditionally to the Client.

B. Digital Products & Licensing (WP2WA Auto Notify)

License purchases grant a non-exclusive right to utilize the software across the authorized domain quota specified in the plan. Base intellectual property remains vested in PT Kemenangan Digital Indonesia. Reselling, reverse engineering, or unauthorized distribution of license keys is strictly prohibited.

5. Technical Warranty & Maintenance Parameters

  • 30-Day Bug Warranty: We furnish a complimentary 30-day technical warranty for bug rectification covering code delivered under the initial Statement of Work.
  • Warranty Exclusions: Coverage excludes defects caused by unauthorized third-party code tampering, external cyberattacks, or client server credential mismanagement.
  • Out-of-Scope Modifications: Requests for new functional modules or modifications outside the initial agreement are treated as supplementary work orders.

6. Limitation of Liability & Governing Law

We are not liable for indirect damages, third-party infrastructure outages (including hosting downtime, sudden Google Play Console policy modifications, or third-party API deprecations), or force majeure occurrences. All disputes shall be settled amicably through good-faith mediation governed by the laws of the Republic of Indonesia.
